These Terms of Service govern your use of the 12K CARBON online store and your purchase of products from us. By accessing the store or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Return and Refund Policy.
Online store terms
You must use the store lawfully and provide current, complete and accurate information. You must not misuse the store, interfere with its operation, introduce malicious code, attempt unauthorised access, or use our products or services for an unlawful purpose.
Products and fitment
We aim to describe and display products accurately. Colours, finishes and carbon-fibre weave appearance may vary slightly because of materials, manufacturing and screen settings. You are responsible for reviewing model, year and fitment information before ordering and for obtaining professional installation where appropriate. Installation, modification or use must comply with applicable laws and vehicle safety requirements.
Nothing in these Terms excludes any guarantee, warranty or remedy that cannot be excluded under the Australian Consumer Law or other applicable law.
Prices and availability
Prices, product availability and promotions may change without notice before an order is accepted. Unless stated otherwise, prices are shown in the currency displayed on the store. International customers may incur duties, taxes and currency conversion charges.
Orders
An order is an offer to purchase. We may accept, reject or cancel an order where a product is unavailable, pricing or product information contains a material error, fraud is suspected, payment cannot be authorised, or fulfilment is not reasonably possible. If we cancel a paid order, we will provide an appropriate refund.
Payment
You agree to provide valid payment and billing information and authorise the applicable charges. Payments are processed by Shopify and third-party payment providers and may be subject to their terms.
Shipping, returns and refunds
Processing and delivery estimates are described in our Shipping Policy. Returns, replacements and refunds are governed by our Return and Refund Policy. Our preferred first remedy for an eligible damaged, defective or incorrect product is generally a replacement, but this does not restrict remedies available under applicable consumer law.
Intellectual property
The store content, branding, text, graphics, product photographs and designs are owned by or licensed to 12K CARBON and are protected by applicable intellectual property laws. You may use the store only for personal shopping purposes and must not copy, reproduce or commercially exploit store content without written permission.
Third-party services and links
The store may use or link to third-party services. We are not responsible for third-party websites or services outside our control. Your use of them may be governed by separate terms and privacy policies.
Disclaimer and limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from use of the store or products. This limitation does not apply where liability cannot be excluded or limited, including rights and remedies under the Australian Consumer Law.
Indemnity
To the extent permitted by law, you agree to indemnify 12K CARBON against claims and reasonable costs arising from your unlawful use of the store, violation of these Terms, or infringement of another person's rights.
Severability and waiver
If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver.
Governing law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws. Mandatory consumer protections in your place of residence continue to apply where required.
Changes
We may update these Terms by posting a revised version on this page. Changes apply prospectively from the date posted.
